Terms of Service

These terms ("Terms") govern your use of alkemyos.com (the "Site") and the alkemy application and related services we make available (together, the "Service"). The Site and Service are operated by DevDash Labs, Inc. ("alkemy", "we", "us"). By creating an account or using the Site or Service, you agree to these Terms. If you do not agree, do not use the Service.
If you use the Service on behalf of an organization, "you" means that organization, and you confirm you have authority to bind it. "Authorized Users" are the people you allow to use the Service under your account. "Customer Content" is the data you and your Authorized Users submit to the Service.
If we have a separate written agreement with you (for example, an order or pilot agreement) that conflicts with these Terms, that agreement controls for the subject it covers.
About the Service
alkemy is an AI-powered platform that helps consulting firms and similar professional teams research companies, qualify opportunities, map relationships, and prepare outreach. The Service is offered on a self-serve basis, including paid credits and subscriptions. We may add, change, or remove features over time. Some features may be labeled beta or preview; those are provided "as is," may change or be withdrawn, and may carry additional terms.
Who can use the Service
You must be at least 18 years old and able to enter into a binding contract. The Service is built for US-based businesses and is intended for users in the United States. We do not actively offer it to, and have not appointed a representative for, the EU or UK; if you use it from there, you do so on your own initiative and are responsible for local compliance.
Your account
You agree to provide accurate account information, keep your credentials secure, and remain responsible for everything that happens under your account, including your Authorized Users' activity. Tell us promptly at founders@alkemyos.com if you suspect unauthorized use.
Acceptable use
You agree not to:
- reverse-engineer, copy, or resell the Service except where the law permits;
- use the Service to violate the law or someone else's rights;
- upload or submit data you do not have the right to process, or that includes special categories of sensitive personal data, unless we have agreed in writing;
- use outputs to make fully automated decisions that produce legal or similarly significant effects about a person;
- interfere with the Service's operation or security, or circumvent access or usage limits; or
- use the Service to build a competing product.
When you provide data about third parties (for example, from LinkedIn or other sources), you are responsible for complying with those sources' terms and applicable law. We may suspend or limit access for a material breach of this section.
Your content and your responsibilities
You own your Customer Content. You grant us a limited, non-exclusive license to host, process, and transmit it solely to provide and support the Service. You are responsible for your Customer Content, including having the necessary rights and a lawful basis to submit it and to have us process it — especially personal data about individuals you research. You are responsible for reviewing outputs before you use or share them.
AI outputs
The Service uses artificial intelligence to generate research, scores, drafts, and answers. AI outputs are produced by automated systems and can be inaccurate, incomplete, out of date, or biased. They are not legal, financial, or professional advice, and similar outputs may be generated for other customers. You must independently verify outputs before relying on them, and you are responsible for how you use them. We do not warrant any particular result.
Data and privacy
Our handling of personal information is described in our Privacy Policy. We do not use your Customer Content to train our or our providers' AI models. A Data Processing Agreement is available to business customers on request.
Fees, credits, and payment
Paid features are sold as credits and/or subscriptions through our payment processor, Stripe. You agree to pay all applicable fees and taxes. Unless the law requires otherwise or we state otherwise in writing, payments are non-refundable and credits are non-transferable. Subscriptions renew on the terms shown at purchase until canceled. We may change pricing on a going-forward basis with notice. Free credits or trials may carry additional limits, and we may revoke them if we detect abuse.
Our intellectual property
alkemy, the alkemy name, the Site design, and all software, documentation, and content we provide (other than your Customer Content and the outputs generated for you) are owned by DevDash Labs, Inc. and protected by US and international intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your internal business purposes during your engagement with us. We reserve all rights not expressly granted.
Confidentiality
Each party may receive non-public information from the other. Each agrees to protect the other's confidential information with reasonable care and to use it only to exercise rights and meet obligations under these Terms — except for information that is public, independently developed, or required to be disclosed by law.
Disclaimers
The Site and Service are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties — express, implied, or statutory — including merchantability, fitness for a particular purpose, non-infringement, and any warranty about the accuracy or reliability of AI outputs. We do not warrant that the Service will be error-free or uninterrupted, or that any specific result will be obtained.
Limitation of liability
To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or relating to these Terms or the Service. Our total liability under these Terms will not exceed the greater of (a) US$100 or (b) the fees you paid us in the twelve months before the claim.
Indemnification
You agree to defend and indemnify DevDash Labs, Inc. against third-party claims arising from your Customer Content, your use of the Service, your violation of these Terms, or your violation of someone else's rights.
Term, suspension, and termination
These Terms apply while you use the Service. Either party may terminate at any time by written notice. We may suspend or limit the Service if you breach these Terms, fail to pay, or create a security or legal risk. On termination, your right to use the Service ends; you may request an export of your Customer Content within 30 days, after which we may delete it as described in the Privacy Policy. Sections that by their nature should survive — including intellectual property, confidentiality, disclaimers, limitation of liability, indemnification, and governing law — survive termination.
Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Before filing a claim, you agree to first contact us at founders@alkemyos.com so we can try to resolve it informally. Any dispute that is not resolved will be brought exclusively in the state or federal courts located in Delaware, and the parties consent to that jurisdiction. To the extent permitted by law, each party waives any right to a jury trial and to participate in a class action.
Changes to these Terms
We may update these Terms as the Service evolves or the law requires. We will change the "Last updated" date above and notify users of material changes. If you keep using the Service after a change takes effect, you accept the updated Terms.
General
These Terms, together with any separate written agreement and our Privacy Policy, are the entire agreement between us about the Service. If any part is unenforceable, the rest stays in effect. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign them without our consent. Neither party is liable for delays caused by events beyond its reasonable control. Our failure to enforce a provision is not a waiver.
